Terms of Use / End-User Licence Agreement (EULA)

This End-User Licence Agreement (EULA) is a legal agreement between you (End-user or you) and Dynamic Methods Pty Ltd ABN 37 149 256 655 of 122 Sturt Street, Adelaide South Australia (Licensor, us, or we) for:

• Forms Live platform and form creation software available at www.formslive.com.au and the associated media (Platform); and
• Online forms created through the Platform (Forms).

We license use of the Platform and Forms to you based on this EULA, as amended from time to time. We do not sell the Platform or Forms to you; we remain the owners of the Platform and Forms at all times.

Operating System Requirements

The Platform requires a system meeting the following specifications:

• Microsoft Windows 10+
• Mac OSX 10.14+
• Linux (e.g., Ubuntu)
• Android 8+
• iOS 12+ (iPad)

Supported Browsers:

• Google Chrome 76+
• Mozilla Firefox 69+
• Safari 12+
• Internet Explorer 11+

Important Notice

• If you do not agree to the terms of this licence, we will not license the Platform and Forms to you, and you must not use the Platform.

Agreed Terms

1. Acknowledgements

• The terms of this EULA apply to the Platform and any services accessible through the Platform, including updates or supplements to the Platform or any Service.
• We may change these terms at any time by notifying you via email or by displaying the new terms for your approval when you next log in to the Platform.
• You acknowledge that internet transmissions are never completely private or secure. Messages or information sent using the Platform may be read or intercepted by others.
• You consent to us collecting and using technical information about your devices and input data for service improvement and other purposes.
• The Platform may contain links to independent third-party websites. You acknowledge and agree to use such websites at your own risk.

2. Grant and Scope of Licence

In consideration of your agreement to abide by the terms of this EULA, we grant you a non-transferable, non-exclusive licence to use the Platform on your devices, subject to the terms of this EULA.

3. Term, Fees, and Payments

The licence is granted for a period of one year, renewable upon payment of fees. Payments must be made in advance using the online payment facility within the Platform.

4. Licence Restrictions

• You may not copy, rent, lease, or modify the Platform except as necessary for backup or operational security.
• You may not disassemble, decompile, reverse-engineer, or create derivative works based on the Platform.
• You must comply with all applicable laws and avoid posting inappropriate or offensive content on the Platform.

5. Acceptable Use Restrictions

• You must not use the Platform in any unlawful manner or to infringe on intellectual property rights.
• You must not resell or repurpose access to the Platform or Services.

6. Intellectual Property Rights

All intellectual property rights in the Platform, Forms, and related technologies belong to us or our licensors. You have no rights to the source code of the Platform.

7. Warranties

We warrant that the Platform will perform substantially in accordance with its description. This warranty does not cover defects caused by misuse or modifications.

8. Limitation of Liability

Our maximum aggregate liability under this EULA is limited to $800, except for liabilities that cannot be excluded by law.

9. Cookies

The Platform may use cookies to improve usability and gather statistics. You may disable cookies, but some functionality may be limited.

10. Termination

We may terminate this EULA if you breach its terms. Upon termination, you must cease all use of the Platform and delete all copies of it from your devices.

11. Communication

12. Events Outside Our Control

We are not liable for any failure or delay caused by events outside our control, including failures of telecommunications networks.

13. Platform Maintenance

From time to time, access to the Platform may be restricted for maintenance or upgrades. We will provide reasonable notice for planned maintenance.

14. Other Important Terms

This EULA is governed by Australian law. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia and the Federal Court of Australia (Adelaide Registry).
